If you have been involved in an accident that was not your fault and more than one cars are involved, you may have the right to hire a replacement vehicle at the cost of the vehicle recovered from the at-fault insurance.
Not At Fault Accident?
You've Got Rights.
If you’re not at fault in an accident with another vehicle, it’s your legal right to be put back into the position you were in prior to the accident. This means being provided with an accident loan car while your car is being repaired, or until your total loss settlement is confirmed. It also means having the costs of your repairs covered.
Under our agreement with you, you will not be liable for the rental and/or repair costs provided you are not at fault, assist us in recovery of those costs from the at fault driver or their insurer and otherwise act in accordance with the terms and conditions of our agreement.
When the accident wasn’t your fault, you’ve got rights that mean you don’t have to make a claim against your own insurance policy. You’re legally entitled to a like for like accident replacement vehicle until your own car is repaired, or until you receive settlement in the case of total loss. You’re also entitled to have your vehicle repaired to manufacturer standards. The accident replacement vehicle and not at fault repairs are at no cost to you. TAMMS are independent accident management experts and we’ll manage the whole process to ensure you get everything you’re entitled to after an accident that wasn’t your fault. Costs will be recovered from the at fault party or their insurer.
